GENERAL TERMS AND CONDITIONS – POLIPOST BUSINESS LTD
The client explicitly waives its own standard terms and conditions, even if these were drawn up after these present General Terms and Conditions of Sale. In order to be valid, any derogation must be expressly agreed to in advance and in writing.
Our invoices are payable within 21 working days, unless another payment timeframe is indicated on either the invoice or the order. In the event of non-payment by the due date, Polipost Business Ltd reserves the right to request a fixed interest payment amounting to 10% of the outstanding sum. Polipost Business Ltd will be authorized to suspend any provision of services without prior notice in the event of late payment.
If any payment remains outstanding for more than sixty (60) days after the payment due date, Polipost Business Ltd reserves the right to engage a debt recovery company. All legal and recovery expenses arising shall be borne entirely by the client.
Certain countries apply withholding tax on the amount of invoices, in accordance with their internal legislation. Any withholding tax will be paid directly by the client to the competent tax authorities. Under no circumstances can Polipost Business Ltd be held responsible for any costs, deductions, or withholdings resulting from the legislation of the client’s country. The full invoice amount shall remain due to Polipost Business Ltd without deduction.
Polipost Business Ltd undertakes to make every reasonable effort to provide high-quality services within the agreed timeframes. However, none of its obligations constitute an obligation of result, but rather an obligation of means. Under no circumstances shall Polipost Business Ltd be required by the client to appear as a third party in any claim for damages filed against the client by an end consumer.
Any claim shall only be considered valid if notified to Polipost Business Ltd by registered letter addressed to its registered office within 8 days from the delivery of goods or the performance of services.
All contractual relations between the parties shall be governed exclusively by applicable law.
